GNU Free Documentation License What happens when you fail a polygraph examination when you are already convicted of a crime? Q. I am on probation for being convicted from a internet sting operation. My PO requested I do a polygraph examination, and the examiner said he had a hard time grading the exam because my breathing rate fell to a low level, and therefore failed me. Now what happens when you are already convicted of a crime, and you fail a full disclosure polygraph does your probation become revoked and do you go back to jail? Asked by bmd420 - Thu Sep 20 05:42:41 2007 - - 5 Answers - 0 Comments A. I fail to understand why your attorney would have you take a polygraph after your conviction and after you had been placed on probation in the first place. Polygraphs are generally not considered as admissible evidence and would be useless for any form of appeal. Failing the test would not be a violation of the terms of your probation, so there should be no legal repercussions.
